Is there a US digital nomad visa for remote workers?
The United States does not currently have a dedicated digital nomad visa. Remote workers employed by foreign companies who want to work in the US while physically present face a complex situation. Generally, performing work while in B-1/B-2 visitor status is not permitted, even if your employer and payment are entirely outside the US.
Some immigration attorneys interpret B-1 business visitor status as permissible for certain incidental remote work activities, but this is a gray area and carries risk. CBP officers can deny entry or revoke status if they determine you are working in a way that violates your status. There is no clear official guidance permitting long-term remote work on a tourist visa.
For those who genuinely need to work from the US, the practical options include obtaining an O-1 visa (extraordinary ability), H-1B via a US employer, or the TN visa for Canadians and Mexicans in qualifying professions. Alternatively, some people establish a US LLC and come in on a B-1 visa for business activities, but this has strict limitations and legal complexity.
