What is the O-1 visa for persons of extraordinary ability?
The O-1 visa is for individuals with extraordinary ability in sciences, arts, education, business, or athletics (O-1A), or extraordinary achievement in the motion picture or television industry (O-1B). Extraordinary ability means a level of expertise indicating the person is among the small percentage who have risen to the very top of their field.
Evidence for O-1 can include major awards, published work with citations, high salary compared to peers, critical roles in distinguished organizations, media coverage, and peer review participation. The petitioner (employer or agent) files Form I-129 with extensive documentation. Unlike H-1B, O-1 has no annual cap and can be filed at any time.
O-1 is approved for up to three years initially with one-year extensions thereafter. There is no maximum duration, making it an attractive option for those who cannot or do not want to go through the H-1B lottery. O-1 can also be a stepping stone to an EB-1A green card (extraordinary ability), which is self-petitioned with no employer sponsorship required.
